Job losses warning as staff win equal pay claim

WORKERS at Bury Council could face “wholesale” job cuts to meet the cost of reimbursing 1,200 female staff who have won a landmark equal pay claim case.

The warning has come from chief executive Mark Sanders days after the Manchester employment tribunal’s ruling virtually paved the way for the women to receive thousands of pounds each.

Their union, Unison, fought and won the equal pay claim against Bury Council during a four-week hearing. The council’s claim that the men were paid more because of a genuine material factor, rather than because of the workers’ sex, was rejected.

And the Manchester tribunal has ruled that the women — who include cleaners, support workers and cooks — will now earn bonus payments of between 33.33 per cent and 50 per cent in line with male colleagues such as refuse collectors, labourers and gardeners.

But with the spectre of the local authority facing a huge cash bill running into millions of pounds, bosses have warned that jobs will have to be axed as a consequence of settling the claims. Mr Sanders said: “The Government needs to consider if it would allow us borrowing approval. If that is the case, we will need to have room in the budget to pay back that borrowing.

“If we don’t get that borrowing, potentially we’re bankrupt. If we do get it, we’ll have to pay it back and have to create room to pay it back. With no room in our budget, there will have to be wholesale cuts to jobs. It’s an appalling scenario.”

In the meantime, however, council chiefs say they are “disappointed” with the result of the tribunal because they believed they were taking the “correct action” in defending the claims.

Now, together with legal counsel, Bury Council will study the verdict in detail and examine its options, including whether to lodge an appeal. The women employees had claimed they were discriminated against and were underpaid for years. Unison subsequently lodged 1,200 claims against the council.

The dispute involved staff in jobs traditionally done by women which had not attracted productivity bonuses paid to male workers in equivalent areas, such as refuse collection, transport and grounds work. The local authority had argued that the claimants didn’t have a case because the people they were comparing themselves against were rewarded for increased productivity.

Hailing the tribunal verdict, Unison General Secretary Dave Prentis said: “We are delighted the women have won pay justice at last. But it is disgraceful that the council chose to spend council taxpayers’ money to the tune of more than half a million pounds on legal fees which have been wasted at the courts. These low paid women are among many who are treated like second class citizens.”

One of the successful claimants is 47-year-old Bev Hodgkinson who has worked for the council for 23 years in a variety of roles. A home care worker at the time of the claim, she said: “I’m absolutely elated. It’s only right we should not be second to the men. We should never have been forced to go down this route and the case has been dragged out for years. We never felt that our work had been recognised, especially when we knew the men were getting paid more. We have finally received justice and, hopefully, this will have an impact on other cases in the future.”

Commenting on the ruling, Mr Sanders added: “It is disappointing, particularly so in case of those members of staff who we know we cannot provide a bonus scheme. As far as those people in caring occupations, we can’t ask them to work faster in terms of caring for people.”

Commenting on the possible job losses, Unison North West head of local government, Ray Short said: “To threaten to cut jobs because Bury Council has to pay out what they owe is outrageous. They have had years to put funding aside to finance equal pay and this win should have come as no surprise. The council is not playing straight with its employees as they will be able to get Government support in borrowing or selling assets to implement equal pay, so cutting jobs need not be an option. They have twice refused our demands to do this.”

l Claims will be successful from six years prior to March 31, 2007 and cover a number of grades. A manual grade one casual assistant may have come against a comparator earning a 33.33 per cent bonus. If her 2007 salary was £11,500, then the bonus would be £3,832.95. So, the total covering the six-year period is potentially £22,997.70.

The study to find Malaysia’s best employers for the year 2009 has been completed. Hewitt Associates, the research firm which carried out the survey has listed 10 of the best employers around in this country.

Hewitt is specialized in the fields of human resources management, talent acquisition, organizational development, investment and business process outsourcing (BPO).

In coming up with the list, a number of criteria has been taken account for such as employee engagement, organizational alignment and business sustainability.

The top ten winners:

1. The Ritz-Carlton (KL)

A chain of luxury hotel, Ritz-Carlton is headquartered in Maryland, United States, and altogether, owns more than 70 hotels across the world, including the one in Kuala Lumpur. The company, which has a long, successful operation spanning for more than a century, is backed by over 30,000 strong employees. The Ritz-Carlton KL offers more than 200 guestrooms and over 30 suites to their customers.

2. American Express

American Express, or also popularly known as Amex, was founded in the 19th century in New York. Its very first business involvement was in the express mail business before diversifications in the business structure almost completely changed the company. American Express today is best known for its range of financial services including credit card, charge card and traveler’s cheques.

3. Four Seasons Langkawi

Intel has major presence in Penang, and has recently invested a significant amount of money to expand its operation in Kulim, the neigbouring state.

9. Golden Arches Restaurants

10. Telekom Malaysia (TM)

TM does not provide the best of products and services and arguably, many of TM customers don’t feel they are given the right treatment. However, the research apparently found out that it is still one of the preferred employers to work with in Malaysia.

Merit-Based Scholarship to be Announced

The government plans to introduced a new category in awarding scholarship which will be purely based on merit.

The aim is to create a level playing field to all candidates regardless of their races, and to increase competitiveness among the students. For long, scholarship awarding system has been touted to treat certain races differently.

If it does happen, Malaysians will see the implementation in place as early as in 6 months. As the number of maximum subjects for SPM is now limited to 10, the move will likely trigger an intense competition among the students aspiring to further their studies locally and abroad.

There is greater possibility that students’ involvement and achievements not related to their academic results will play the decisive factor in getting the scholarship.

According to the Prime Minister, Datuk Seri Najib Tun Razak, a study is now underway to assess and evaluate the distribution and allocation of scholarship which is under the purview of Public Service Department (PSD).

However, the specific details about the new scholarship award and the mechanism of work is yet to be released.

Jika ya, dapatkan pandangan dan maklumbalas mengenai mutu perkhidmatan, kepantasan serta tahap profesionalisme yang diberikan oleh jururunding dari agensi yang berkenaan kepada calon pekerja. Jika maklumbalas yang diterima adalah positif, mulakan langkah anda dengan menghubungi mereka.

Buat sedikit kajian

Selain daripada mendapatkan pandangan dan maklumbalas daripada rakan rakan atau saudara mara, buat sedikit kajian atau research tentang agensi pekerjaan yang ingin anda dekati. Ini boleh dilakukan dengan melawat laman web syarikat tersebut, membuat carian di laman web pencari (seperti Google, Yahoo dsb) atau menghubungi sendiri agensi pekerjaan tersebut melalui telefon. Jika anda seorang eksekutif teknologi maklumat, adakah agensi tersebut menawarkan banyak peluang pekerjaan dalam bidang kepakaran anda?

Teliti proses dan prosedur

Juga, jangan lupa untuk meneliti proses dan prosedur sewaktu berurusan dengan mana mana agensi pekerjaan. Adakah sebarang pembayaran dikenakan? Jika ada, anda MESTI berhati hati dan jangan terlalu mudah untuk menyerahkan beberapa ratus ringgit kepada mereka kerana kebanyakan daripada agensi pekerjaan yang meminta wang selalunya akan hanya akhirnya memberi berita buruk kepada anda. Jika anda dipanggil untuk temuduga, buat janji temu pada waktu dan tarikh yang sesuai untuk anda.

Jangan bergantung 100%

Dalam berusaha mendapatkan kerja, jangan hanya mengharapkan usaha anda kepada agensi pekerjaan. Sebaliknya, anggap ini sekadar alternatif. Selain daripada agensi pekerjaan, banyak lagi medium lain yang boleh memberikan hasil yang berkesan. Antaranya adalah menghubungi sendiri syarikat yang anda minati dan bertanyakan proses jika anda mahu menghantar resume anda. Selain daripada itu, luangkan masa anda untuk memperbaiki resume anda dengan mendapatkan maklumbalas daripada jururunding kerjaya serta melihat contoh contoh resume yang baik untuk dijadikan panduan.

Jangan dekati agensi pekerjaan ‘scam’

Jangan sekali kali terpedaya dengan muslihat agensi pekerjaan tidak bertauliah yang kononnya menawarkan peluang kerjaya yang ‘mudah, cepat dan lumayan’. Banyak kes kes yang melibatkan rakyat Malaysia yang diperangkap da akhirnya terjebak dengan aktiviti aktiviti tidak sihat termasuklah jenayah penyeludupan dadah. Ingat, tidak ada apa di dunia ini yang boleh diperolehi dengan terlalu mudah tanpa usaha yang gigih dan bersungguh sungguh.


PNB Scholarship for 663 Students

PNB or Permodalan Nasional Berhad has awarded scholarship to 663 successful recipients. The scholarship will enable all the selected students to pursue their higher studies in institutions across the country as well as in overseas.

Out of the over 600 number, 470 are for those continuing studies locally, whereas the remaining are those hooked up with foreign institutions.

A portion of the students are currently studying in well known schools outside of the countries, especially in the United Kingdom, including Oxford University, Cambridge, London School of Economics and Imperial College of Science, Technology and Medicine.

PNB offers its coveted scholarship every year, and intends to continue awarding the scholarship for many years to go.

From an Engineer to a Salesman

THE experience of having been retrenched twice while having to care for his family gave Simon Poi the determination to try a job he had once detested - sales.

Even though it was tough going at first, the Computer Science and Math graduate, eventually achieved success in his venture.

Poi had started working as a programmer in 1988 and then a Software Engineer in 1991 before moving on to work as a Geographic Information Systems (GIS) manager five years later.

However, in his last job, Poi was asked to work in the sales department of his company.

The 45-year-old then had no experience in doing sales and was not confident and hence resigned from his job.
“I had always wanted to try sales but it all sounded too difficult for me then,” said Poi who opted to learn about doing sales the hard way.

He bought washing detergents and pet food from a wholesaler and sold them at night markets near his home every week for two months while looking for new jobs.

“I had to convince the housewives there and being new at the place, it was not easy to sell anything,” said the soft-spoken Poi.

The father of two said he was a shy person and hesitant to talk to people he was not close to.

“I was always very nervous when I needed to make a sales call, sometimes I even hung up, not knowing what to say when my customers questioned me,” said Poi.

Earning just RM800 a month, he knew he had to work harder if he wanted to be a successful salesman one day.

Poi said to gain confidence, he practised talking in front of mirrors as well as standing up to talk instead of sitting at his table.

“Every day before I leave home, I would look into the mirror and say loudly that I am the best, for self motivation,” he said.

After a few years, luck was on his side when he met a Korean friend whom he had liaised with during his earlier working days.

“He found out that I had left the job and was selling detergents. We met up and he passed me a sample of a Korean floor cleaner which he said I should try.

“Believe me, I was amazed with the outcome and thought the cleaner was excellent,” said Poi who then passed the sample to a chemist friend for testing before teaming up with him to produce a similar product using the Korean-based technology.

The two started the Semarak Resources with four workers to sell the detergent to local grocery shops and supermarkets in Poi’s hometown, Seremban, as larger retailers were not interested in the product.

His first attempt was a failure as housewives returned the detergent saying their floors were rather sticky after using it.

“We took back all the stock and conducted tests.

“We came up with a better product and introduced the ‘buy one free one’ concept for a month to regain confidence among the users,” said Poi, adding that the effort paid off.

Currently, the products named “Y-Slimz” (www.y-slimz.com) are available at major supermarkets and hypermarkets in the Klang Valley, Perak and Malacca.

His advice to those seeking jobs is not to be choosy and try new ideas.
